Please read these Official Rules before entering the 2010 POLICY COMMUNICATORS CONTEST ("Contest") sponsored by Association of Private Enterprise Education, Inc. ("Sponsor"). By entering this Consent, you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of Sponsor and the judges, and that you satisfy all eligibility requirements. Upon receiving your submission, Sponsor will confirm by email that you have agreed to be bound by these Official Rules. If you do not respond to the Sponsor's email requesting confirmation that you have agreed to be bound by these Official Rules, you will not be eligible to participate in the Contest.

ELIGIBILITY. Entrants must be affiliated with a U.S. academic department, either as a graduate student in good standing or as an appointed faculty member (of any rank). There is no cost to participate in the Contest, and no purchase is necessary. The Contest is subject to all applicable federal, state and local laws. The Contest is not open to employees or immediate family members (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren) or those living in the same household of employees of Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any participant that it determines is ineligible to participate in the Contest. Failure to comply with these rules may result in a participant's disqualification.

HOW TO ENTER. To enter, you must submit an original, unpublished, essay (the "Entry"). There is a 3,000-5,000 word limit for the essay. Your Entry should address the relationship between public policy and economic growth . It is of particular interest to compare and contrast individual countries, states, regions or major metro areas, and to address why some are succeeding and others are failing. Diverse public policies have resulted in an equally diverse set of outcomes affecting economic performance. Therefore, it is of great importance to discern what lessons can be drawn from specific experiences. The submission period ends February 20, 2010 at 11:59 p.m. (U.S. Eastern Standard Time). The Entries must be submitted in English and must include full references. All Entries must be submitted as a Microsoft Word .doc, and all Entries must be submitted electronically to edward.lopez@sjsu.edu . Sponsor will NOT accept or review Entries that are not submitted according to the Official Rules.

CONDITIONS OF ENTRY. All Entries must be the original creations of the entrants. By submitting an Entry, each entrant represents and warrants that his/her Entry (a) is his/her original creation; (b) has not previously been published; (c) does not violate or infringe any copyright, trademark, privacy or publicity right, or other proprietary or intellectual property rights (collectively, referred to as the "Intellectual Property Rights") of any person or entity; (d) is not defamatory, libelous, obscene, or otherwise illegal; and (e) is the sole and exclusive property of the entrant and does not require the consent of any third party or entity of any jurisdiction. Each entrant further represents and warrants that he/she has complete, worldwide distribution rights for his/her Entry. You agree to indemnify and agree to hold harmless Sponsor, its members, directors, assignees, officers, employees and agents from any liability arising out of the submission of the Entry in violation of the representations and warranties contained herein or to which you do not own the Intellectual Property Rights.

GRANT OF RIGHTS. Entrants retain ownership of Entry. However, by submitting an Entry, each entrant hereby grants and licenses to Sponsor and its licensees and assigns, without seeking the approval of the entrant or making any payment of any kind to entrant, a nonexclusive, irrevocable and permanent transfer to Sponsor of the right to use, copy, sublicense, assign, edit, modify, make derivative works, publish, exploit, transmit, distribute, publicly perform, delete or display the Entry, in whole or in part, in perpetuity, in any and all media (whether now existing or hereafter devised) and throughout the world, without any limitation, and without consideration or acknowledgment to the entrant. In addition, Entries or excerpts thereof, along with the author's name, city and state of residence, may also be posted on any Web site owned or operated by Sponsor, its agents or any of their affiliates ("Sponsor Site"), any other Web site or other online point of presence on any platform, in Sponsor's sole discretion. Sponsor's decision to post the Entry or any portion of an Entry on any Sponsor Site does not mean that the selected Entry has been selected as a winning Entry.

JUDGING AND PRIZES. The Sponsor will select the top three qualified Entries and will notify the potential winners by phone or e-mail. There will be three prizes awarded: a First Place Prize of $15,000; a Second Place Prize of $7,500; a Third Place Prize of $4,000. If an entrant cannot be reached by email within ten (10) business days of the first attempt to notify them, the prizes may be forfeited and the next successful entrant will receive said prizes. Winners agree to have their photograph(s) taken by the Sponsor for use by Sponsor in announcing Contest winners and for the purpose of promoting the Contest and the Entry, including the promotion of the Contest on any Sponsor Site.

MISCELLANEOUS PROVISIONS. Contest is void outside the eligible jurisdictions and where prohibited by law. Entrants agree that the decisions of Sponsor related to the Contest are final and binding in all matters. Sponsor reserves the right to suspend, cancel, terminate or modify the Contest without advance notice, and thereafter to re-commence such Contest, if at all, only at such time(s) and upon such terms and conditions, as Sponsor shall deem reasonable under the circumstances.

TAXES. It is the sole responsibility of the winning entrant to pay all federal, state, local, and foreign taxes in connection with a prize award. Winners may be required to submit his or her taxpayer identification number to claim the prize and the Sponsor may be required to report the prize to federal and state tax authorities.

LIMITATIONS AND REMEDIES. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE SPONSOR, OR ITS SUCCESSOR, ASSIGNS OR LICENSEES, OR ANY OF THEIR MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS OR HARM TO BUSINESS OR REPUTATION, ARISING OUT OF PARTICIPATION IN THE CONTEST, TO THE MAXIMUM EXTENT PERMITTED BY LAW. THE AGGREGATE LIABILITY OF THE SPONSOR ARISING OUT OF ANY KIND OF CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE) SHALL NOT EXCEED $1.00.

JURSIDICTION; VENUE. Any dispute that may arise hereunder, if not settled by the parties directly or through alternate dispute resolution, shall be brought solely in the appropriate state or federal court sitting in the Tennessee, subject to the paragraph immediately below, and entrants consent to the personal jurisdiction and venue thereof. The laws of Tennessee (without giving effect to its conflict of laws principles) govern all matters arising out of or relating to these Official Rules.

WAIVER OF JURY . As a condition of participating in this Contest, each entrant hereby irrevocably and perpetually waives any right that entrant may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under, or in connection with Contest, any document or agreement entered into in connection with Contest, any prize available through Contest, and any of the transactions contemplated related to Contest.
